各县(市、区)人民政府、市直各单位:
《晋城市实施〈山西省预算外资金管理条例〉的办法》已经晋城市第二届人民代表大会常务委员会第三十次会议于1995年4月22日通过,现予印发,望认真贯彻执行。
晋城市实施《山西省预算外资金管理条例》的办法
第一条 为了适应社会主义市场经济发展的需要,加强预算外资金管理,提高预算外资金的使用效益,根据《中华人民共和国预算法》、《山西省预算外资金管理条例》(以下简称条例),结合我市实际情况,制定本办法。
第二条 本办法适用于市级以下各级人民政府及其所属部门;其它国家机关(包括各级党委所属机关及司法机关)、群众团体(包括各级工会、共产主义青年团、妇女联合会以及其它社会团体组织)、全民所有制企业、事业单位(包括实行全额预算、差额预算、自收自支及实行企业化管理的事业单位)(以下简称各地方、各部门、各单位)预算外资金的收支和管理活动。
第三条 预算外资金是指由各地方、各部门、各单位根据国家和省的有关规定,收取、提留和安排使用不纳入国家预算管理的资金,主要包括:
(一)财政部门管理的预算外资金。收入项目主要有按规定收取的农业税附加、城市公用事业附加等附加收入和集中的专项资金(基金)以及其它预算外收入。
(二)行政事业单位管理的预算外资金。收入项目主要有各项行政性收费、事业性收费、事业专项收入、服务性收入、各种专项基金以及其它不纳入国家预算的资金。
(三)国有企业留用的资金。主要是指根据《企业财务通则》和《企业会计准则》等有关规定提取留用的税后利润、折旧、职工福利基金、业务活动费等资金。
第四条 预算外资金管理坚持宏观调控、微观搞活、统一领导、分级管理和权责结合以及专款专用、先收后支,先批后用、量入为出的原则。
第五条 各种人民政府应加强对预算外资金管理工作的领导,负责组织实施有关预算外资金管理的法律、行政法规,编制本级预算外资金收支计划和决算,组织本级预算外资金收支计划的执行,编制本级预算外资金收支计划的调整方案。
第六条 各种财政部门是预算外资金管理的职能部门,其主要职责是:
(一)组织贯彻实施有关预算外资金管理的职能部门,其主要职责是:
(二)根据法律、法规、规章和政策制定预算外资金管理办法,协调节器好预算内外资金的综合平衡。
(三)会同物价部门审核、报批行政事业性收费项目、标准;制定行政事业性收费财务管理制度;负责行政事业性收费、票据印制、发放、监督、管理;组织实施对行政事业单位预自然外资金的财政“专户储存”管理。
(四)审核、汇总、编报预算外资金收支计划、执行情况和决算。定期向本级人民政府和上一级财政部门报告。
(五)管理和监督检查预算外资金的收支活动,依法查处违反预算外资金管理规定的行为。纠正或废止有关部门关于预算外资金管理不适当的规定。
第七条 各种计划、银行、审计、物价等有关部门应根据各自的职责,协同财政部门做好预算外资金的管理、监督和引导工作。
第八条 预算外资金收支单位的职责:
(一)认真执行有关预算外资金管理的法律、法规、规章和政策以及经财政部门认可的上级主管部门制定的具体管理办法。
(二)建立、健全财务制度,加强预算外资金的收支管理,接受财政、审计等监督部门的监督检查。
(三)按规定的范围和标准及时足额征收、提取本单位的预算外资金。
(四)按照《条例》规定,将预算外资金及时足额交存财政专户储存。
(五)严格按同级政府或财政部门批准的预算外资金支出计划安排使用资金。
(六)编报预算外资金收支计划、执行情况和决算。
第九条 各地方、各部门、各单位预算外资金的征集、收取、提留、上缴必须严格执行有关法律、法规和省有关规定。具体为:
(一)财政部门预算外资金由各级财政部门按照国家和省政府及其财政主管部门规定的项目、范围和标准进行征收和集中。
(二)行政事业单位预算外资金按照国家和省政府以及省财政厅、省物价局规定的有关项目、范围和标准进行征集、收取。
各地方、各部门需申请新设立或调整行政事业性收费项目、范围、标准,由市财政部门会同市物价部门组织论证审核后联合行文,报省财政厅、省物价局审批;重要的收费项目,由市财政、物价部门共同组织论证审核,经市人民政府同意后,报省财政厅、物价局审批。
(三)国有企业预算外资金按照《全民所有制工业企业法》、《全民所有制工业企业转换经营机制条例》、《企业财务通则》和《企业会计准则》等有关规定提取、留用。
第十条 行政事业性收费实行许可证制度和使用专用票据制度。收费部门和单位应当持批准文件到物价部门领取收费许可证。要公开收费项目、范围和标准,实行亮证收费。
行政事业性收费须使用财政部门统一印制或监制的票据,并按照规定批准的项目、范围和标准收取。财政部门要严格票据管理,实行交旧领新,定量供应。未持收许可证和未使用财政部门统一印制、监制票据进行收费的,视为非法收费,被收取费用的单位或个人有权拒付。对于非法收费,任何单位和个人都有权向财政、物价部门举报。
第十一条 行政事业单位的预算外资金的在所有权、使用权不变的前提下,实行财政专户会储存管理。在预算外资金收支活动的各行政事业单位应凭财政部门出具的开户证明,在指定银行开设“收入解户”和“支出结算户”两个帐户,实行收支 两条线管理。
“收入上解户”的资金只收不支,核算本单位的预算外资金收入、利息收入和上级拔入的预算外资金。“收入上解户”不得办理支出业务。各单位预算外资金应于次月十日内由单位填写《预算外资金专用交款书》(见附表一),从开户银行“收入上解户”内全额转入同级财政部门在银行开设的集中代管预算外资金专户,任何单位不得截留、坐支。
各单位行政性收费、事业性收费和各种预算外资金(基金)收入必须全额存入同级财政专户。服务性收入,扣除成本、费用的净结余存入同级财政专户。“支出结算户核算由财政部门按其批准的支出计划从财政专户拨入本单位的资金,由单位按批准用途支付使用。“支出结算户”不得办理收入结算事项。各单位除国家另有规定外,只能在一个银行开户,不得多行开户。没有财政部门出具的开户证明,银行不得为其单位开户,留存印鉴。
存入财政专户的预算外资金,按国家规定付利息,并归存入单位。
第十二条 各行政事业单位的预算外资金必须纳入本单位财务机构统一管理,严禁转移资金,公款私存,逃避财政专户监督。
第十三条 各地方、各部门、各单位应当按照有关规定,及时编制预算外资金的收支计划。预算外资金年度收支计划的编制,按以下程序、权限执行:
(一)财政部门预算外资金年度收支计划,由各级财政部门会同计划和有关部门按照规定提出收支计划。
(二)预算外专项资金的年度收支计划。各级人民政府授权各行政只能部门及有关企业事业单位代收代管的煤炭能源基地建设基金、煤炭生产补贴款、煤炭专项维简费、城市基础设施配套费、城市增容费、生产资料交易市场管理费、基本农田保护建设资金、新菜地开发基金等体现政府行为的各项生产建设性、社会公益性预算外专项资金(基金),其所有权为各级人民政府,在原征收渠道不变和资金用途不变的前提下,实行政府统一管理、财政专户储存,由各项资金的业务主管部门会同财政、计划及有关部门规定提出收支计划。
(三)行政事业单位预算外资金的收支计划,由各单位按照规定提出年度计划。财政部门预算外资金和预算外专项资金的使用应纳入同级地方年度国民经济和社会发展计划及本级政府的综合财政计划,保证主要资金应集中用于对全市经济发展有重要作用的骨干项目。
有预算外资金收支活动的各行政事业单位,应于每个年度的一月份内编制年度预算外资金收支计划,并报送同级财政部门和主管部门,经财政部门和主管部门审核、汇总后,由财政部门编制同级地方年度预算外资金收支计划,报经同级人民政府综合平衡、研究同意后,提请同级人大常委会审议、批准。
第十四条 预算外资金用于基本建设和技术改造的,根据其资金所在权的不同,分别执行以下办法:
财政部门预算外资金和属政府所有由各部门、各单位代收代管的预算外专项资金用于基本建设和技术改造部分,应按规定程序报批,列入同级地方年度国民经济和社会发展计划。
属行政事业单位所有权的预算外资金用于基本建设,应执行“先审后存、先存后用”的原则。由朦胧和款单位提出申请。填报《自筹基本建设资金申请表》(见附表三),经主管部门同意并签注意见,报同级财政部门审核后,计划部部门方可安排自筹基建计划,自筹基建计划落实后,财政部门将其资金从财政专户划转到财政部门在建设银行开设的自筹基建专户,由建设银行根据有关规定和程序拨付用款单位资金。未经审查,计划部门不得列入基本建设计划,建设银行不得划拨资金。
第十五条 行政事业单位用预算外资金购买国家专控商品,应先提出书面申请,经同级财政部门审查资金来源,同意购买并签注意见后,控购部门方可办理专控商品审批手续。
第十六条 国有企业留用资金,由企业根据《全民所有制工业企业法》、《全民所有制工业企业转换经营机制条例》、《企业财务通则》、《企业会计准则》等有关规定自主安排使用,接受财政、审计、银行部门的指导和监督。任何部门、单位不得随意向企业集资、摊派和平调留用资金。
第十七条 各级政府和行政事业单位严格执行批准的年度预算外资金收支计划。
财政部门预算外资金和预算外专项资金的支出,根据批准的年度预算外资金收支计划,由各项资金的业务主管部门会同计划、财政部门提出具体项目投资计划,报经市(县、区)长常务办公会议或市(县、区)长审定后,财政部门按审定的项目投资计划及项目建设进度拨付资金,各用款单位必须严格按照批准的项目投资计划使用资金。
行政事业单位预算外资金的支出,按照批准的年度预算外资金收支计划,由各单位在每季开始的十日前向同级财政部门编制季度用款计划一式四份(见附表二),经财政部门审核批准后,由财政部门按批准计划将资金按月拨入用款单位的“支出结算户”,由开户银行监督使用。未经财政部门批准的支出,银行有权拒绝支付。特殊情况下的急需用款,可随时报批。各行政事业单位应严格按照批准计划使用资金。财政部门要统筹安排行政事业单位的预算内、外资金,视单位的事业需要和收入规模,本着多收适当多支的原则,可适度核定预算外收入抵支预算内拨款的数额。
有预算外资金的各行政事业单位应分别于月、季、年终了后的十日内向同级财政部门报送预算外资金收支计划情况。
第十八条 经本级人大常委会议批准的预算外资金收支计划如需进行调整,同级人民政府应编制预算资金收支计划调整方案,提请本级人大常委会审查和批准。未经批准,不得调整预算外资金收支计划。
第十九条 各级财政部门应保证专户储存单位的正当用款,及时审批用款计划,并按计划、按程序、按进度拨付资金,不得推诿、拖延,贻误专储单位使用资金,开户对银行对已经财政批准支出的款项应及时支付,不得借故压票。财政、银行应尽量为专户储存单位提供方便,寓管理于服务之中。
第二十条 各级财政部门在保证专户储存单位正常用款的前提下,可运用财政专户的间歇资金进行有偿融通支持生产和事业的发展,提高资金使用效益。对确定支持项目必须进行可行性论证,公开办事制度 ,规范审批程序,保证借出资金安全回收。对专户储存单位的借款项目优先予以安排。
第二十一条 鼓励公民、法人和其它组织对预算外资金收支和管理活动中的违法行为进行举报,对举报有功的,财政部门可给予奖励。
第二十二条 认真执行《条例》和本《实施办法》,在预算外资金管理工作中做出显著成绩的单位和个人,由县级以上人民政府给予表彰、奖励。
第二十三条 县级以上人民代表大会常委委员会,应听取和审议同级人民政府关于预算外资金收支和管理情况的报告,监督同级人民政府及有关部门对预算外资金管理的法律、行政法规和本办法的贯彻执行。
第二十四条 凡有下列违法行为之一的,按照,《条例》和国家有关法律、法规,分别情况给以警告、通报、批评,并可按以下规定予以处罚:
(一)擅自增设预算外资金收费项目,扩大范围,提高标准的,责令取消项目,纠正违法行为,没收违法所得,并处违法款额1倍至3倍罚款。
(二)未按规定办理收费许可证或未使用财政部门印制、监制票据的,没收违法所得,并处违法款额5%至10%的罚款;
(三)未按规定进行专户储存,或者弄虚作假、隐瞒不报、转移资金、坐支资金,逃避财政监督的,由财政部门通知开户银行将应纳入专户储存的资金直接划转财政专户,并处违法款额5%至10%的罚款;
(四)自筹基本建设基金未按规定程序报批,责令限期纠正,并处违法款额10%至20%的罚款;
(五)款经财政部门审查用预算外资金购买专控商品的和挪用专项基金的,没收违法款额,并处违法款额15%至30%的罚款;
(六)擅自扩大预算外资金开支范围,滥发资金、补贴、津贴、实物的,责令限期纠正,并处违法款额15%至30%的罚款;
(七)将预算外资金公款私存的,没收其全部款额,并处违法款额外负担1倍至2倍的罚款;
(八)违反行政事业性收费票据管理规定的,除《条例》有规定外,按《山西省行政事业性收费票据管理规定》进行处罚。
第二十五条 凡有二十四条所列行为之一的单位,对其直接负责的主管人员和其他直接责任人员,处本人基本工资1个月至3个月的罚款,并可给予或者建议有关部门、单位给予行政处罚。
第二十六条 当事人对处罚决定不服的,可在收到处罚通知书之日起15日内向作出处罚决定机关的人一级机关申请复议,上一级机关应在收到复议申请书之日起三十日内作出复议决定;对复议决定不服的,可在收到复议决定书之日起15日内向人民法院起诉,逾期不申请复议,不起诉又不履行处罚决定的,由作出处罚决定的机关采用行政手段或申请人民法院强制执行。
第二十七条 财政、银行、物价等部门的工作人员,在预算外资金的管理和监督工作中玩忽职守,徇私舞弊,由所在单位或上级主管部门给予行政处分。
第二十八条 违反《条例》构成犯罪的,由司法机关依法追究刑事责任。
第二十九条 本办法执行中的具体问题由市财政局负责解释。
第三十条 本办法自一九九五年五月一日起施行。

PART II INCORPORATION AND POWERS

The Consumer Council existing at the commencement of this
Ordinance is

The Council shall consist of the following members--

Appointment of staff and advisers
Subject to subsection (4), the Council shall appoint a person to

PART III FINANCIAL
Resources of Council
The Governor may, out of money appropriated for the purpose

The resources of the Council shall consist

money paid to the Council by way of donations, fees,
subscriptions,

all other money and property, including accumulations of

Council may, with the approval of the Financial Secretary,

The Council shall keep proper accounts and proper records in

The Council

The Council shall within 3 months after the receipt by it

a report on the affairs of the Council for that year;

the auditor's report on the accounts, to the Governor who shall
cause
same to be tabled in the Legislative Council.
PART IV GENERAL
Council not servant or agent of Crown
Council is not a servant or agent of the Crown and does not enjoy
any
us, immunity or privilege of the Crown.
Governor may give directions
The Governor may, if he considers that the public
interest so
ires, give to the Council such directions as he thinks
fit with
ect to the exercise and performance by the Council of its
powers,
tions and duties under this Ordinance, either generally or
in any
icular case.
The Council shall comply with any direction given to
it under
ection (1).
Protection of members of Council and committees
No member or employee of the Council or of any committee
of the
cil shall be personally liable for any act done or default made--
by the Council; or
by any committee of the Council, acting in good faith in the course
of
operations of the Council or of the committee.
The protection hereby conferred on members and employees
of the
cil or of a committee in respect of any act or default shall not
in
way affect any liability of the Council for that act or default.
Prohibition of exploitation of the Council's name for
advertisement
oses
No person shall, with a view to promoting or disparaging any
s, services or immovable property or promoting the image
of any
on, publish or cause to be published any advertisement which
either
essly or by implication makes reference to--
the Council;
any committee, member, agent or employee of the Council;
the Council's publication or finding of tests or surveys
conducted by
n behalf of the Council; or
any other information published by the Council, without
written
ent of the Council.
Any person who contravenes subsection (1) commits an offence
and is
le to a fine of $ 100,000.
For the purpose of subsection (1) "advertisement" may be
constituted
ny words, whether written or spoken, or any picture, drawing,
visual
e, figure or article--
appearing in any publication; or
brought to the notice of the public or any section of the public
in
other way. (Replaced 5 of 1992 s. 5)
Transitional provisions
All property of whatever kind and whether movable or immovable
vested
r belonging to the Consumer Council existing at the
commencement of
Ordinance shall as from that date vest in or belong to that
Council
ts corporate capacity without any further assurance.
All obligations and liabilities of the said Consumer Council
are as
the commencement of this Ordinance the obligations and
liabilities of
Council in its corporate capacity.
Where anything has been commenced by or under the authority
of the
Consumer Council before the commencement of this Ordinance such
thing
be carried on any completed by the Council in its corporate
capacity.
Every person who immediately before the commencement of this
Ordinance
s an appointment as Chairman, Executive Director or a member of
the
Consumer Council is, as from such commencement but subject to
the
s of his appointment, the Chairman, Executive Director, or a
member of
Council, as the case may be, for the purposes of this Ordinance.
Notwithstanding the definition of "financial year" in section
2 the
od between the commencement of this Ordinance and 31 March 1978
shall
eemed to be a financial year.
No stamp duty shall be payable in respect of any transfer of
property
r this section.
